Closed Network Test Terms of Use for "Crazy Taxi: World Tour"

SEGA CORPORATION (hereinafter referred to as "SEGA")
Effective Date: [July/1/2026]

With respect to the "Closed Network Test" (hereinafter referred to as the "Test") for "Crazy Taxi: World Tour" (hereinafter referred to as the "Game") conducted by SEGA, any individual who wishes to participate in the Test is required to carefully read and agree to the following terms and conditions (hereinafter referred to as these "Terms"). Individuals who participate in the Test shall be referred to as "Participants."

1. Conditions for Participation and Use

  • (1) These Terms set forth the conditions for participation in the Test. If you agree to these Terms, you may participate in the Test upon such agreement. By using the Test, you shall be deemed to have understood and agreed to these Terms.
  • (2) In order to participate in the Test, you may be required to download and install software separately designated by SEGA (hereinafter referred to as the "Distributed Software"). Participants shall download and install the Distributed Software after agreeing to these Terms. The Distributed Software is licensed on a non-exclusive and non-sublicensable basis solely for the purpose of the Test. Participants shall not use the Distributed Software for any purpose other than the Test.
  • (3) Participation in the Test is limited to individuals who are 14 years of age or older. Agreement to and acceptance of these Terms by the Participant shall be a prerequisite for participation in the Test. If a Participant is a minor under the laws of their country or region, such Participant must obtain the prior consent of a parent or legal guardian before agreeing to these Terms. If you do not agree to these Terms, you must decline participation in the Test.
  • (4) SEGA may amend these Terms without the prior consent of Participants. In the event of any amendment, SEGA shall notify Participants of the amended Terms, the effective date thereof, and other necessary matters by posting on the official website operated by SEGA (hereinafter referred to as the "Official Site") or by other appropriate means.
  • (5) Eligibility to participate in the Test shall be limited to individuals who agree to these Terms, are selected by SEGA for participation in the Test, and satisfy all of the following conditions. Individuals who do not meet these requirements are not eligible to participate in the Test. Participant selection may be conducted through one or more methods, including random selection and priority consideration programs. Selection decisions may be based on factors such as application volume, platform, region, participant capacity, technical requirements, participation in community programs, and other operational considerations. Participation in community programs or receipt of priority consideration benefits may increase an applicant's likelihood of selection, but does not guarantee participation in the Test. SEGA is not required to disclose the details of its participant selection criteria, selection process, or the reasons for any individual selection or non-selection decision.
    • (a) Individuals residing in countries or regions where the Test is conducted
    • (b) Individuals who possess hardware and a network environment that satisfy the applicable minimum technical requirements for participation in the Test
    • (c) Individuals who maintain a valid and accessible email address
    • (d) Individuals who bear the costs necessary for internet connection required to participate in the Test (participation itself is free of charge)
    • (e) Individuals who are willing to actively participate
    • (f) Individuals who agree to provide SEGA with information regarding devices and network environments used for the Test, and to respond to questionnaires, when designated by SEGA
    • (g) Individuals who agree that their play data (which may include personal data) may be processed, stored and analyzed by SEGA to aid in the development of the Game in exchange for access to this Test

2. Imperfection of the Test

  • (1) The Test is conducted as a demonstration test of an online game system and its related systems, utilizing services that are still under development, for the purpose of collecting information and evaluating the service toward completion of the final product and services to be provided in countries and regions designated by SEGA.
  • (2) The Game and the Distributed Software are under development, and by their nature, there is a high probability that bugs, defects, or malfunctions may occur. Participants shall fully recognize such probability and shall take protective measures such as backing up data prior to launching the Game or installing the Distributed Software at their own responsibility.

3. Information Related to the Test and Information Provided by Participants

  • (1) All copyrights and other intellectual property rights regarding information provided through the Test and the Distributed Software belong to SEGA or third parties having legitimate authority. Participants shall not, without the prior and explicit permission of SEGA or the relevant third-party rights holder, copy, publicly transmit, publish, modify, or otherwise use such information or the Distributed Software.
    Among the information provided through the Test, information designated by SEGA (hereinafter referred to as "Confidential Information") constitutes non-public information prior to release to the general market and shall form part of SEGA’s confidential information. Participants shall manage the Confidential Information as confidential, shall not disclose or leak it to any third party, and shall not use it for any purpose other than participation in the Test, except where such information becomes publicly known, disclosure is required by law, or SEGA has expressly permitted such disclosure.
  • (2) Notwithstanding the preceding paragraph, where SEGA provides such functionality as part of the Test or expressly permits otherwise, Participants may capture or record content relating to the Test and publish such content on social media or other media platforms. However, Participants shall not use such content in a manner that distorts the content or intent of the Test or may cause misunderstanding to third parties. If SEGA determines that publicly posted content violates this paragraph and requests its cessation, deletion, or correction, the Participant shall promptly comply with such request.
  • (3) With respect to any information submitted by Participants to SEGA through postings or other means during the Test, Participants shall grant SEGA a non-exclusive and royalty-free right to reproduce and distribute such information. Even if Participants submit ideas or proposals relating to products or marketing, SEGA and its group companies may use such ideas free of charge without any obligation to evaluate, consider, adopt, or maintain confidentiality.

4. Participation in the Test

  • (1) Participants shall comply with detailed rules and instructions specified by SEGA when participating in the Test. The duration of the Test shall be separately determined by SEGA.
  • (2) In order to participate in the Test, Participants must use the Distributed Software to connect via the internet to servers designated by SEGA (hereinafter referred to as the "Server"). The operating hours of the Server may be set or modified by SEGA at its discretion.
  • (3) Participants shall, at their own responsibility and expense, prepare communication equipment, configure network settings, enter into agreements with providers, and bear all fees necessary for connection to the Server.
  • (4) Participation in the Test may require the download and installation of update programs (patches) in addition to the Distributed Software. In such cases, these Terms shall also apply to such downloads and installations.

5. Personal Information of Participants

  • (1) In connection with the Test, Participants shall provide and register personal information in accordance with methods designated by SEGA (including logging into a SEGA Account), where required for operations related to the Test.
  • (2) Participants shall register accurate and official information.
  • (3) Participants shall promptly notify SEGA of any changes to registered information in accordance with designated methods.
  • (4) SEGA may use personal information provided by Participants within the scope necessary for the purposes set forth in SEGA’s Privacy Policy, for operations related to the Test, for creation of internal marketing materials, for providing information regarding the Game to Participants, and for securing SEGA’s rights.
  • (5) SEGA may entrust the management of personal information to third parties within the necessary scope, provided that such third parties are obligated to manage such information appropriately.
  • (6) SEGA shall not disclose or leak personal information to third parties without prior consent of the Participant, except in the following cases:
    • (a) Where required by laws and regulations
    • (b) Where disclosure is requested by an entity with legal authority
    • (c) Where disclosure is unavoidable to protect or restore SEGA’s rights from imminent or unlawful infringement
    • (d) Where personal information is provided to a successor in connection with transfer of business relating to the Game
  • (7) Participants may request correction of their own information within a reasonable scope through methods designated by SEGA.
  • (8) In addition to the foregoing, personal information shall be handled in accordance with SEGA’s Privacy Policy.

6. Accounts

  • (1) Participants shall not allow any third party to use accounts used for the Test and shall bear full responsibility for their management and use.
  • (2) SEGA shall not be liable for damages incurred by Participants due to use of their account by a third party, except in cases of intentional misconduct or gross negligence by SEGA.
  • (3) Any participation conducted through a Participant’s account shall be deemed to be the responsibility of such Participant.

7. Prohibition of Cheating and Unauthorized Activities

  • (1) When participating in the Test, Participants shall not engage in any of the following acts (hereinafter referred to as "Cheating and Unauthorized Activities"):
    • (a) Tampering with or unlawfully creating data of the Game
    • (b) Engaging in acts other than those reasonably envisaged or permitted for an online game
    • (c) Intentionally altering the content, progress, or structure of the online game, including by altering normal operation or changing the storyline
    • (d) Impersonating SEGA employees or customer support personnel
  • (2) Regardless of whether participating in the Test or not, Participants shall not distribute (including making transmittable) programs or data that enable Cheating and Unauthorized Activities to other Participants or third parties.
  • (3) Participants shall not exploit any bugs or defects that may exist in the Test or the Server for the purpose of obtaining an unfair advantage in the Game.
  • (4) Participants shall not intentionally alter, decompile, disassemble, reverse engineer, analyze, or adapt any data or messages transmitted to or from the Server.

8. Use of Matching and Communication Features

  • (1) The Test may provide matching features allowing Participants to compete with each other, and communication features using fixed messages. Participants shall use such functions only within the scope of the purpose of the Test. Participants acknowledge in advance that SEGA does not provide any guarantee with respect to availability, matching speed, number of opponents, selection of opponents, communication quality, or any other operation of such functions.
  • (2) Participants shall not engage in any of the following acts when using matching or competitive features:
    • (a) Intentional disconnection, manipulation of communication, leaving the game idle, or any other act that interferes with the progress of a match
    • (b) Unjustly avoiding, interfering with, or manipulating the matching process
    • (c) Colluding with a third party to unfairly manipulate match results such as wins and losses
    • (d) Harassing, provoking, or causing discomfort to opponents
  • (3) Participants shall not engage in any of the following acts when using communication features:
    • (a) Insulting, provoking, or engaging in nuisance conduct that causes discomfort to other Participants using fixed messages
    • (b) Sending messages excessively or repeatedly beyond what is necessary
    • (c) Using external services or tools to contact other Participants outside the Game
    • (d) Collecting, guessing, or attempting to identify personal information of other Participants
  • (4) SEGA shall bear no responsibility for any disputes arising between Participants in connection with matching or communication. However, where SEGA deems it necessary, SEGA may investigate and take measures it considers appropriate, including suspension of participation or termination of provision of the Game.

9. General Prohibitions

When participating in the Test, Participants shall not engage in any of the following acts:

  • (a) Conduct contrary to public order and morals, including obscene or discriminatory expressions
  • (b) Acts constituting or leading to criminal offenses
  • (c) Infringement of rights of other Participants or third parties (including but not limited to honor rights, privacy, and copyrights)
  • (d) Commercial activities (including solicitation), political activities, or religious activities
  • (e) Acts that violate or may violate applicable laws and regulations
  • (f) Acts that interfere with or may interfere with the operation of the Test or related services
  • (g) Tampering with third-party software or data used in communication or storage
  • (h) Unauthorized use of accounts or disclosure, leakage, resale, transfer, lending, or pledging of accounts
  • (i) Use of the Test in a manner not intended by SEGA
  • (j) Violation of any provision of these Terms
  • (k) Tampering with information provided through the Test
  • (l) Unauthorized access to SEGA facilities or viewing, copying, or altering data therein
  • (m) Acts that incite speculative or gambling tendencies among Participants
  • (n) Acts intended to receive money or goods, such as fundraising or solicitation of investment
  • (o) Collection of information about other Participants
  • (p) Providing false information in account registration
  • (q) Transmitting harmful data, text, or programs
  • (r) Any other act deemed inappropriate by SEGA

10. Disclaimer of Warranties

  • (1) The Test is not guaranteed to be available under all environments. Accordingly, SEGA does not guarantee that the Test will be available under any particular environment used by the Participant.
  • (2) The Test (including the Distributed Software and functions provided therein) is conducted for demonstration purposes, and by its nature may contain defects in accuracy, completeness, usefulness, reliability, and safety. Accordingly, SEGA provides no warranties of any kind regarding the Test.

11. Save Data

  • (1) SEGA makes no warranty that save data will be stored or retrieved without defects.
  • (2) SEGA may modify or delete save data without prior consent of Participants if deemed necessary for the Test.
  • (3) Save data may be used only for the Test and will not be carried over to any other service.

12. Interruption and Termination of the Test

  • (1) SEGA may temporarily interrupt the Test at any time without prior notice for the purpose of testing or verification.
  • (2) Notwithstanding Section 4(1), SEGA may terminate the Test at its discretion without prior notice.
  • (3) SEGA shall bear no liability for damages arising from interruption or termination unless caused by SEGA’s intentional misconduct or gross negligence.

13. Notices and Communications

  • (1) SEGA may limit notices, communications, and support regarding the Test to the Japanese language.
  • (2) SEGA may limit access to the Test to countries, regions, platforms, or operating environments designated by SEGA.
  • (3) SEGA shall provide notices to Participants via the Official Site, in-game messages, or email. Participants shall promptly notify SEGA of any changes to registered information.
  • (4) Participants shall regularly check notices from SEGA.
  • (5) Participants shall contact SEGA via designated forms. SEGA will not respond to inquiries by telephone or in-person visits.

14. Limitation of Liability

  • (1) TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SEGA SHALL NOT BE LIABLE FOR ANY DAMAGES INCURRED BY PARTICIPANTS IN CONNECTION WITH PARTICIPATION IN THE TEST, EXCEPT WHERE SUCH DAMAGES ARE ATTRIBUTABLE TO SEGA’S NEGLIGENCE EVEN TAKING INTO ACCOUNT THAT THE GAME AND SERVER PROGRAMS ARE PROVIDED FOR TESTING PURPOSES.
  • (2) EVEN WHERE SEGA IS LIABLE, SUCH LIABILITY SHALL BE LIMITED TO DIRECT AND ACTUAL DAMAGES INCURRED BY THE PARTICIPANT. SEGA SHALL NOT BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR LOST PROFITS, REGARDLESS OF FORESEEABILITY, EXCEPT IN CASES OF INTENTIONAL MISCONDUCT OR GROSS NEGLIGENCE BY SEGA.
  • (3) SEGA SHALL NOT BE LIABLE FOR DAMAGES CAUSED BY THIRD-PARTY SOFTWARE EXCEPT IN CASES OF INTENTIONAL MISCONDUCT OR GROSS NEGLIGENCE BY SEGA.

15. Measures Against Violations

If a Participant violates any provision of these Terms, SEGA may immediately restrict, suspend, or prohibit future participation in the Test or use of the Game, or take any other measures deemed necessary.

16. General Provisions

  • (1) These Terms shall be governed in all respects by the laws of Japan. Matters not provided herein shall be governed by applicable laws including the Copyright Act, Civil Code, and Commercial Code.
  • (2) If any provision is held invalid under mandatory law, the remaining provisions shall remain in effect.
  • (3) Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court or Tokyo Summary Court as the court of first instance.

16-2. FOR RESIDENTS IN THE U.S. AND CANADA

Notwithstanding Section 16(3), the dispute resolution provisions, including the arbitration and class action waiver provisions, contained in Sections 19 and 20 of the Sega of America, Inc. Terms of Service shall apply to residents of the United States and Canada.

17. Miscellaneous

In the event of any conflict between these Terms and other terms specified by entities other than SEGA, these Terms and other SEGA terms shall prevail.

18. Special Provisions Regarding Backtrace

For the purpose of improving quality and resolving defects, the Test uses "Backtrace" provided by Backtrace I/O, Inc. ("Backtrace"). SEGA and Backtrace will collect the following information, which will not be used to identify individual Participants:

  • (a) Application version, OS version, device name, and screen size
  • (b) Usage status such as communication conditions and memory status
  • (c) Crash information including time and location of occurrence
  • (d) Application ID assigned to the Participant
